Financial Disclosure Requirements for State Office Candidates and Officeholders

Candidates for public are required to report expenditures and contributions made to bring about their nomination or election.  The reports must be received in the Lt. Governor's Office by 5 p.m. on the due date or clearly postmarked 3 days before the due date.  If a candidate fails to file the required financial disclosure reports, the Lt. Governor will disqualify the candidate and remove his or her name from the ballot.

***Starting May 12, 2009, all Candidates/Officeholders need to report each contribution within 30 days after the contribution was received.

What happens when the report due date is on a Saturday, Sunday, or holiday?

The Election Code extends the deadline to the next business day when a due date falls on a Saturday, Sunday, or holiday (see Utah Code section 20A-1-401). For example, January 10, 2010 is a Sunday, therefore, the report is actually due on Monday, January 11, 2010.

When exactly is seven days before a convention or election date?

The Election Code directs that the day of an event is not counted when calculating the number of days before the event (see Utah Code section 20A-1-401). For example, if a party convention is held on Saturday, May 3, 2008, then seven days before that convention is Saturday, April 26, 2008. As explained above, since that deadline falls on a Saturday, the report is actually due on Monday, April 28, 2008 and should include contributions received and expenditures made through Wednesday, April 23, 2008.

Filing a Financial Disclosure Report Electronically

   Candidates should file financial disclosure reports electronically by using the Disclosure Website.

Step 1: Contact the Lt. Governor's Office by e-mail at disclosure@utah.gov or call (801) 538-1041 to obtain a user ID and password.

Step 2: Go to the www.disclosures.utah.gov.

Step 3: Log into the Utah Reporting System by entering your user ID and password.

Step 4: Begin entering contributions and expenditures.

Step 5: Submit report. You must click “Submit Report” for your report to be submitted to the Lt. Governor's Office.

Note: Financial Disclosure reports must be received in the Lt. Governor’s Office by 5 p.m. on the due date.  If a candidate fails to file the required financial disclosure reports, the candidate will be disqualified.

Reports that are hand-delivered must be turned in to the Lt. Governor's Office by 5 p.m. on the due date.

By Mail

If a report is mailed, it must be postmarked at least 3 days before the due date to be considered timely filed.

By Fax
Reports can be faxed to (801) 538-1133 and must arrive in the Lt. Governor's Office by 5 p.m. on the due date. Please do not wait until the last minute to fax, as the Lt. Governor's office has 1 fax machine, and it may be difficult to fax as it gets closer to the deadline.
